Zaloba Terms of Service

1. Acceptance of Terms & Operator Identification

Welcome to Zaloba. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Lienskill Limited ("Lienskill", "we", "us", or "our"), a company incorporated in Kenya, governing your access to and use of the Zaloba communications software, including our mobile applications, web platform (web.zaloba.chat), public site (zaloba.chat), and associated services (collectively, the "Service"). Zaloba is a product and platform operated by Lienskill Limited.

By downloading, registering for, accessing, or using Zaloba, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our related policies. If you do not agree to these Terms, you must not access or use the Service.

2. Account Registration, Identity & Device Pairing

Zaloba employs an email-first account model:

• Email Ownership: You must register using a valid email address that you own or have authorized access to. Authentication occurs via verification passcodes dispatched to that address.
• 16-Digit Zaloba Number: You are issued a unique 16-digit Zaloba Number upon registration (PREFIX@16DIGITS). This number is your public identifier within the Zaloba network.
• Credential & Device Security: You are responsible for safeguarding your primary mobile device and active sessions. Any action initiated through your authenticated account is presumed to have been authorized by you.
• Web Pairing Revocation: When pairing a browser terminal via visual QR code, you are responsible for terminating sessions on shared devices upon concluding your work.

3. User-Generated Content (UGC) & Responsibility

Zaloba enables users to transmit and publish content, including text messages, photos, videos, voice notes, profile avatars, biographies, and 48-Hour Status updates.

• User Responsibility: You retain ownership of content you transmit. You are solely responsible for all content, communications, and media you submit, transmit, or display through the Service.
• License to Operate the Service: You grant Lienskill Limited a non-exclusive, worldwide, royalty-free license solely to host, transmit, store, and deliver your content as strictly necessary to provide the communication services to your designated recipients.
• No Unlawful Material: Lienskill Limited does not endorse or assume liability for user-generated content, and strictly prohibits objectionable, harmful, or unlawful material as set forth below.

You agree to use Zaloba solely for lawful personal and commercial communication. You expressly agree that you will NOT transmit, upload, post, share, or facilitate any of the following:

5. Content Reporting, Investigation & Account Enforcement

Zaloba provides in-app reporting tools for messages and users, as well as instant contact blocking.

Lienskill Limited reserves the right, upon receiving a user report or identifying credible safety concerns, to take any of the following enforcement actions:

• Investigation: Review reported messages, account information, and associated context.
• Content Restriction: Remove or restrict access to violating media, status posts, or messages.
• Account Suspension & Termination: Temporarily suspend or permanently terminate offending Zaloba accounts.
• Law Enforcement Referral: Where required or appropriate under applicable law, credible reports involving child sexual abuse material or child endangerment may be referred to competent law-enforcement authorities and relevant child-protection organizations.

6. Service Availability & Modifications

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Core messaging capabilities are provided without subscription fees.

7. Termination & Account Deletion

You may stop using Zaloba at any time. You may request permanent deletion of your account through our public deletion resource at https://zaloba.chat/account-deletion or by emailing our Privacy Team at privacy@zaloba.chat.

Deleting your Zaloba account terminates access to the account and initiates removal or de-identification of personal data associated with it, subject to technical, legal, safety, backup, and shared-conversation retention requirements. Content already delivered to other participants may remain in their conversation history where appropriate.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Lienskill Limited and its directors, employees, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to access the Service.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya governing Lienskill Limited. Any legal disputes arising out of or in connection with these Terms shall be submitted to the competent courts of Kenya.
